Photography is professional intellectual property created through accredited formal education, extensive experience, and significant equipment investment—legally equivalent to musical compositions and sound recordings. Accessing, viewing, or downloading media does not transfer copyright ownership, convey communal rights, or place images into the public domain.

2. AI SCRAPING & MACHINE LEARNING PROHIBITION

   You may not use, copy, scrape, crawl, or extract any media, images, or content from this website to train, fine-tune, or feed artificial intelligence (AI) algorithms, machine learning models, neural networks, or generative media software. Any unauthorized extraction or utilization of images for AI training constitutes willful copyright infringement and shall subject the violating party to liquidated damages in the amount of $10,000 per image, per instance or day of use, plus reasonable legal fees and enforcement costs.

3. TERMS FOR FREE DIGITAL DOWNLOADS & EVENT GALLERIES

   • Usage: Downloads are granted under a limited, good-faith Personal Use License strictly for non-commercial personal enjoyment and non-commercial social media sharing. Commercial use, business advertising, resale, or performer/band promotional campaigns (including album art, merchandise, posters, and press releases) are strictly prohibited without prior written consent and an executed commercial license.

   • File Quality: Free downloads may feature a watermark and are optimized strictly for web/screen display. They are web-resolution files optimized strictly for digital screen display, and are unsuitable for high-resolution physical printing or commercial reproduction. High-resolution, unwatermarked prints and licensed digital files are available via the store.

   • No Alterations: Do not edit, alter, apply filters to, crop, or remove watermarks or identifiers from the images.

   • Mandatory Attribution: When posting or featuring any photo from EHT Photos on social platforms, you must attribute credit where customary and technically feasible as follows:

4. PRIVATE CLIENT & PAID DELIVERIES

   For private client galleries or paid services, your specific photo contract, agreement, and/or checkout Terms of Sale supersede Section 3 above regarding file resolution and printing rights. These documents are subject to the master Terms of Service and Privacy Policy of EHT Photos. Standard high-resolution digital purchases made through the EHT Photos store convey a non-exclusive private use license only. Commercial, promotional, advertising, artist marketing, or media publication uses are strictly prohibited under standard digital sales and require a separate written commercial or media license.

5. PUBLIC EVENT, FESTIVAL GALLERY PHOTOS & LIKENESS DISCLAIMER

   Photos featured in public event, festival, or educational retreat galleries (including but not limited to California Bluegrass Association, Strawberry Music Festival, and Walker Creek Music Camp) are captured in public or semi-public spaces under standard journalistic and gathering norms. Attendance at such events constitutes implied consent to being photographed in crowd, workshop, and performance settings. EHT Photos relies on event hosts to warrant that appropriate participant media releases have been obtained. EHT Photos assumes no liability regarding initial capture expectations of privacy. If you or your minor child appear in an event gallery and you wish to request image removal, please submit an expedited request via our Contact page with the specific image link.

6. DMCA / COPYRIGHT NOTICE & DESIGNATED AGENT

   If you believe that any content hosted on this website infringes upon your copyright, please submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our U.S. Copyright Office-registered Designated Agent with the following information in writing: a physical or electronic signature of a person authorized to act on behalf of the owner; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing and instructions reasonably sufficient to permit us to locate the material; your contact information (address, telephone number, and email); a statement of good faith belief; and a statement under penalty of perjury that the information is accurate. 7. LIMITATION OF LIABILITY, INDEMNIFICATION, FORCE MAJEURE & "AS-IS" DISCLAIMER

   This website, its galleries, and all media are provided on an "as-is" and "as-available" basis without warranties of any kind. EHT Photos shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from your use of this site, website downtime, or technical errors.

   • In no event shall the total aggregate liability of EHT Photos to any user or buyer for all damages exceed the exact amount paid by the user to EHT Photos for the specific product or service in question.

   • You agree to indemnify, defend, and hold harmless Evan Thompson / EHT Photos from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your unauthorized commercial use, unauthorized band promotion, or unauthorized alteration or watermark removal of any images downloaded or purchased from this website, or any third-party claims arising from your public event behavior or usage.

   • Event Host Rights Limitations: Promotional media licenses granted to event hosts (such as festival or camp organizers) are non-transferable and non-sublicensable. Event hosts do not possess authority to grant third-party commercial rights to performers, vendors, or sponsors.

   • Force Majeure: EHT Photos is not liable for any failure to perform or delay in fulfilling services, print fulfillments, or digital delivery due to causes beyond its reasonable control, including but not limited to acts of God, severe weather events, natural disasters, utility or internet outages, equipment failure, severe illness, government restrictions, or venue shutdowns.

8. GOVERNING LAW & JURISDICTION

   This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action, dispute, or proceeding arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in Sonoma County, California (or Santa Rosa, California, where applicable).

9. SEVERABILITY

   If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
